Sawari Rides operates a technology platform that connects passengers with independent, licensed drivers through a mobile application. These Terms of Service govern your use of the Sawari Rides application and any transportation service you arrange through it. Please read them carefully before using the platform.
By creating an account, downloading the application, or requesting a ride, you confirm that you have read, understood, and agreed to be bound by these Terms and conditions. If you do not agree, you must not use the platform.
Sawari Rides is an independent company registered and operating in Bhaktapur, Bagmati Province, Nepal. It has no parent company, subsidiary, or affiliated venture. All services are governed by the applicable laws of Nepal. Where anything in these Terms conflicts with those laws, the law prevails.
We may update these Terms from time to time. We will notify you of any changes through the application or by message to your registered contact. Your continued use of the platform after receiving notice of a change means you accept the updated Terms.
Sawari Rides is a technology intermediary, not a transportation provider. We operate an application that allows you to book rides with independent, licensed drivers who have been registered and verified under the applicable laws of Nepal. When you book a ride, your contract for that transportation is between you and the driver — not with Sawari Rides.
We are responsible for: operating the platform, verifying that drivers and vehicles meet the standards required by the law, maintaining the safety features of the application, and handling complaints in accordance with the laws.
We are not responsible for: the conduct of any driver during a trip, any accident or injury arising from a trip, or the quality of any transportation service provided to you. These responsibilities rest with the driver.
To use the Sawari Rides platform, you must:
You may only have one account on the platform. You may not share your account with or transfer it to any other person. If we find that an account has been created using false information, or that an account is being shared or misused, we may suspend or terminate it without notice.
To travel as a passenger on a two-wheeled vehicle, you must be over 10 years of age and under 80 years of age.
To book a ride, open the application, enter your pickup location and destination, and confirm the booking. The application will display the available vehicle, the driver's name and photograph, the vehicle registration number, the estimated distance, and the applicable fare before you confirm. Please review this information carefully before proceeding.
Once a booking is confirmed, both you and the driver are notified. You may track the driver's location in real time as they approach your pickup point. All trips must be booked and conducted through the application. Arranging rides directly with a driver outside the application is not permitted.
However, where you aren't able to use the Application, the driver may provide the service through the QR system. Sawari offers a convenient QR scanning feature, which allows you to connect instantly with nearby drivers by scanning a unique QR code displayed on the driver’s device. When you scan a driver’s QR code, we capture essential ride-related data, including both the passenger’s and driver’s identities, current location, timestamp, and subsequent route information. This ensures seamless ride initiation, efficient verification, and accurate tracking for safety and billing purposes. This will be applicable to the respective party on whose behalf the ride has been booked.
A single trip on a two-wheeled vehicle must not exceed the maximum distance specified by applicable laws and regulations. The application will not allow you to book a trip that exceeds this distance on a two-wheeled vehicle.
All vehicles operating on the Sawari Rides platform are required to observe a maximum speed of 40 km/h in urban areas. If you feel your driver is exceeding this limit, you may use the in-app safety alert or file a complaint with our support center.
Fares on the Sawari Rides platform are set in accordance with the base rate prescribed by the applicable laws of Nepal. The fare for your trip is calculated on the basis of distance and time and is displayed to you in the application before you confirm your booking. No fare charged through the platform may exceed the standard rate set by the prescribed laws.
A minimum fare equivalent to 2 km applies to every trip, regardless of actual distance, to account for driver waiting and approach time. Payment may be made by cash or through a digital wallet at the end of your trip.
A statutory provincial/federal levy on the trip fare is deducted from each transaction and remitted to the provincial/federal government. This is not a fee charged by Sawari Rides.
Once a trip is complete, payment is due in full. If you have a complaint about the service provided during a trip, please raise it through our complaint process — do not withhold payment as a means of dispute. No driver may charge a fare higher than the amount displayed in the application. If a driver demands additional payment, please report it immediately through the application or our support center.
Using the Sawari Rides platform comes with certain responsibilities. By booking a ride, you agree to the following:
If you harass, abuse, or cause harm to a driver, the driver has the right to file a complaint with our support center or the Traffic Police. Where a complaint against you is upheld, we may suspend or permanently ban your account. Serious incidents may be referred to law enforcement. Passengers proven to have caused deliberate harm to a driver may also face legal action under the Act and applicable criminal law.
Your safety is our priority. The Sawari Rides application includes the following safety features, all of which are required under the Regulations:
We strongly encourage you to save an emergency contact in the application settings before your first trip.
In-App Advertisements: The App may display third-party advertisements, promotions, and sponsored content (“Ads”). These Ads are necessary to maintain, improve, and provide certain free or subsidized services within the platform.
Third-Party Interactions: Clicking on any Ad may redirect you to a third-party website or application. Sawari Ride does not endorse, warrant, or control the content, products, or privacy practices of these third-party links. Any engagement or transaction with advertisers is solely between you and the third party.
Data Privacy & Personalization: To show relevant advertisements, Sawari Ride may use non-personally identifiable data (such as device type, location data, or in-app behavior) in accordance with our Privacy Policy.
User Disruption: We strive to ensure that advertisements do not interfere with your core ride-booking experience, safety features, or emergency buttons.
Notwithstanding anything herein written, the Company may, at its sole and absolute discretion, blacklist you permanently or temporarily and reject your request to use the Application and/or Service or any part thereof for such reasons as it deems fit, including but not limited to receiving complaints about you from third-party providers or employees of the Company regarding your behavior or interaction with anyone whatsoever (including but not limited to third-party providers, the Company’s employees, law enforcement, and government authorities) whilst and/or before using the Service.
Our support center is available 24 hours a day, seven days a week, accessible by phone, email, or through the application. Contact details are displayed within the application and are updated with the Ministry and the Transport Management Office as required.
If you have a complaint about a trip — including driver’s conduct, route deviation, overcharging, vehicle condition, or any safety concern — please file it within 24 hours of the trip ending. We will investigate and respond to you within three days of receiving your complaint.
Where a complaint involves serious misconduct by a driver — including driving under the influence, harassment, or any act that endangered your safety — the driver's account will be immediately suspended pending investigation. You may also file a complaint directly with the Traffic Police in cases of serious incidents. You have the right to report any driver to the Traffic Police directly in the event of serious misconduct, and you do not need to wait for the Company's complaint process to complete before doing so.
You are responsible for keeping your account credentials confidential. Do not share your password or account access with anyone. If you suspect that your account has been accessed without your authorization, notify us immediately through the support center. We are not liable for any loss arising from unauthorized access due to your failure to protect your credentials.
You must ensure that all information in your account — including your name, phone number, email address, and payment details — is accurate, current, and complete at all times. You may update your information through the application at any time. If we discover that your account contains materially false or misleading information, we may suspend or terminate your access to the platform.
By registering on the platform, you consent to Sawari Rides collecting and processing your personal data for the purposes of operating the Service, processing payments, maintaining safety, handling complaints, and complying with our regulatory obligations under applicable Act and Regulations. We handle your data in accordance with our Privacy Policy, which is also available within the application.
In accordance with the Regulations, we are required to provide data — including your trip records — to the Nepal Government, Province Government, the Transport Management Office, the Ministry, or the Traffic Police upon lawful request. We will comply with such requests immediately and in full as required by law.
Trip data is retained for a minimum of six months unless a longer period is specified in applicable laws. At least your last 90 days of trip history is always accessible to you through the application.
You may request deletion of your account at any time through the application or by contacting our support center. Account deletion requests are processed within 90 days of verification. Some data may be retained beyond this period where required by applicable law or ongoing legal or regulatory proceedings.
You agree that this Agreement shall be subject to all prevailing statutory taxes, duties, fees, charges, and/or costs. You further agree to use your best efforts to do everything necessary and required by the relevant laws to enable, assist, and/or defend the Company to claim or verify any input tax credit, set-off, rebate, or refund in respect of any taxes paid or payable in connection with the Service supplied under this Agreement.
You are responsible for any damage to a driver's vehicle that results from your conduct during a trip. This includes damage caused by spilling, soiling, breakage, or any other act attributable to you. Where a damage or cleaning claim from a driver has been verified by Sawari Rides, we may recover the reasonable cost of repair or cleaning from you through your registered payment method or by direct demand.
To protect the integrity of the platform and the safety of all users, the following rules apply to all customers:
Violation of any of these rules may result in immediate suspension or permanent termination of your account, and applicable criminal law may apply in addition to platform-level consequences.
All rights in and to the Sawari Rides application, its software, design, trademarks, logos, and content belong exclusively to the Company. Nothing in these Terms grants you any ownership interest in or rights to the application beyond the limited right to use it for personal, non-commercial purposes in accordance with these Terms. You must not reproduce, distribute, or commercially exploit any part of the application without our prior written consent.
Sawari Rides provides a technology platform to connect you with drivers. We do not provide transportation services and are not responsible for the conduct or performance of any driver during a trip. To the maximum extent permitted by law, Sawari Rides shall not be liable for any loss, injury, damage, or harm, whether direct, indirect, or consequential, arising from your use of the platform or any transportation service you receive through it. However, any losses that are covered under the passenger’s accidental insurance will be indemnified by insurance companies as per our insurance policies. We will support the necessary arrangements to claim the insurance in case an accident occurs.
The application is provided on an “as is” basis. We make no guarantee that the application will be available at all times, free from errors, or compatible with your device. We are not responsible for delays, failures, or losses arising from internet connectivity issues, device faults, or any technical problem outside our reasonable control.
Sawari Rides may suspend or terminate your access to the platform at any time, with or without notice, if you breach any provision of these Terms, violate the Act or the Regulations, or engage in conduct that endangers the safety or wellbeing of any driver, third party, or other road user. Termination does not entitle you to any compensation or reimbursement for any loss of access to the platform.
You may close your account at any time by contacting our support center. Closing your account does not affect any outstanding payment obligations or any matter already referred to complaint or legal proceedings.
These Terms are governed by the laws of Nepal. Any dispute arising from these Terms or your use of the platform shall be subject to the applicable laws and regulations and the exclusive jurisdiction of the competent courts of Nepal.
We encourage you to raise any concern with our support center first. Many issues can be resolved quickly without formal proceedings.
If any provision of these Terms is found to be invalid or unenforceable, it shall be severed without affecting the remaining provisions. These Terms represent the entire agreement between you and Sawari Rides regarding the use of the platform and supersede all prior communications and understandings on the same subject.
These Terms have been prepared in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.
